(a) Warranty.<\/strong> TAJIMA TOOL CORPORATION (\u00ab\u00a0TAJIMA TOOL\u00a0\u00bb) warrants that, for a period of THREE MONTHS from the date of original retail purchase (the \u00ab\u00a0Warranty Period\u00a0\u00bb),<\/p>\r\n\r\n

(b) Implied Warranties.<\/strong> ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE IS LIMITED IN DURATION TO THE WARRANTY PERIOD. EXCEPT FOR THE WARRANTY SET FORTH IN SECTION (a) AND ANY IMPLIED WARRANTY AS SO LIMITED, TAJIMA TOOL MAKES NO OTHER WARRANTY, EXPRESS OR IMPLIED, WITH RESPECT TO THE PRODUCTS.<\/p>\r\n\r\n

(c) Who Is Covered.<\/strong> TAJIMA TOOL extends this limited warranty only to the person who originally purchased the product. It does not extend to any subsequent owner or other transferee of the product.<\/p>\r\n\r\n

(d) How to Obtain Warranty Service.<\/strong> TAJIMA TOOL provides warranty service through the dealers and retailers that sell its products. To obtain warranty service:<\/p>\r\n

  1. \r\n1.<\/span>\r\nWithin the Warranty Period, contact the dealer, retailer, or online seller from which you purchased the product (the \u00ab\u00a0Place of Purchase\u00a0\u00bb), and present the product together with your original receipt or invoice showing the date of purchase. For online purchases, follow the Place of Purchase’s return or warranty claim procedure.<\/li>\r\n
  2. \r\n2.<\/span>\r\n The Place of Purchase will submit your claim to TAJIMA TOOL using the Return Order Form designated by TAJIMA TOOL, together with photographs of the product and of your receipt or invoice.<\/li>\r\n
  3. \r\n3.<\/span>\r\n TAJIMA TOOL will review the claim and may request that the product be returned for examination.<\/li>\r\n
  4. \r\n4.<\/span>\r\n If TAJIMA TOOL reasonably verifies that the product is defective and covered by this limited warranty, you will receive the remedy described in Section (h) from the Place of Purchase.\r\n<\/li>\r\n<\/ol><\/p>\r\n\r\n

    (e) No Direct Claims to TAJIMA TOOL.<\/strong> Except as provided in Section (f), TAJIMA TOOL does not accept warranty claims directly from end users and does not provide replacement products or refunds directly to end users. All warranty claims must be made through the Place of Purchase.<\/p>\r\n\r\n

    (f) Exclusions.<\/strong> This limited warranty does not cover any damage due to: (1) transportation; (2) storage; (3) improper use; (4) failure to follow the product instructions or to perform any preventive maintenance; (5) modifications; (6) unauthorized repair; (7) normal wear and tear; or (8) external causes such as accidents, abuse, or other actions or events beyond TAJIMA TOOL’s reasonable control.<\/p>\r\n\r\n

    (g) Remedy.<\/strong> Subject to Sections (d) and (f), for any product found to be\r\ndefective during the Warranty Period, TAJIMA TOOL will provide, through the\r\nPlace of Purchase, a replacement of the same product.<\/p>\r\n\r\n

    (h) Exclusive Remedy.<\/strong> THE REMEDIES SET FORTH IN SECTION (g) SHALL BE YOUR SOLE AND EXCLUSIVE REMEDY AND TAJIMA TOOL’S ENTIRE LIABILITY FOR ANY BREACH OF THE LIMITED WARRANTY SET FORTH IN SECTION (a).<\/p>\r\n\r\n

    (i) Exclusion of Damages.<\/strong> IN NO EVENT SHALL TAJIMA TOOL BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOSS OF USE, REVENUE OR PROFIT OR FOR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, WHETHER ARISING OUT OF BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE AND WHETHER OR NOT TAJIMA TOOL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.<\/p>\r\n\r\n

    (j) Limitation of Liability.<\/strong> IN NO EVENT SHALL TAJIMA TOOL’S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS LIMITED WARRANTY, WHETHER ARISING OUT OF OR RELATED TO BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, EXCEED THE PURCHASE PRICE PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.<\/p>\r\n\r\n

    (k) No Other Authority.<\/strong> No dealer, retailer, agent, or employee of TAJIMA TOOL or of any Place of Purchase is authorized to modify, extend, or add to this limited warranty, or to refuse a claim on the ground that warranty claims must be made directly to TAJIMA TOOL.<\/p>\r\n\r\n

SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.<\/p>\r\n\r\n
