(a) TAJIMA TOOL CORPORATION (\u201cTAJIMA TOOL\u201d) warrants that for a period of\r\nTHREE MONTHS from the date of original purchase of the products (\u00abWarranty\r\nPeriod\u00bb), that such products will be free from defects in material and workmanship.<\/p>\r\n\r\n

(b) EXCEPT FOR THE WARRANTY SET FORTH IN SECTION (a), TAJIMA TOOL\r\nMAKES NO WARRANTY WHATSOEVER WITH RESPECT TO THE PRODUCTS,\r\nINCLUDING ANY (1) IMPLIED WARRANTY OF MERCHANTABILITY AND (2)\r\nIMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE.<\/strong><\/p>\r\n\r\n

(c) TAJIMA TOOL extends this limited warranty only to someone who originally\r\npurchased the product. It does not extend to any subsequent owner or other\r\ntransferee of the product.<\/p>\r\n\r\n

(d)TAJIMA TOOL shall not be liable for a breach of the warranty set forth in Section\r\n(a) unless (i) you provide Return Order Form designated by TAJIMA TOOL, picture of\r\nthe products, and picture of receipt or invoice of the products during the Warranty\r\nPeriod, (ii) TAJIMA TOOL is given a reasonable opportunity to review Return Order\r\nForm and to examine pictures, (iii) you return the product to TAJIMA TOOL if\r\nrequested by TAJIMA TOOL, and (iv) TAJIMA TOOL reasonably verifies your claim\r\nthat the product is defective. <\/p>\r\n\r\n

(e) This limited warranty does not cover any damage due to: (1) transportation; (2)\r\nstorage; (3) improper use; (4) failure to follow the product instructions or to perform\r\nany preventive maintenance; (5) modifications; (6) unauthorized repair; (7) normal\r\nwear and tear; or (8) external causes such as accidents, abuse, or other actions or\r\nevents beyond TAJIMA TOOL\u02bcs reasonable control.<\/p>\r\n\r\n

(f) Subject to Section (d) and Section (e) above, with respect to any such products\r\nduring the Warranty Period, TAJIMA TOOL shall replace such products.<\/p>\r\n\r\n

(g) THE REMEDIES SET FORTH IN SECTION (f) SHALL BE YOUR SOLE AND\r\nEXCLUSIVE REMEDY AND TAJIMA TOOL\u02bcS ENTIRE LIABILITY FOR ANY\r\nBREACH OF THE LIMITED WARRANTY SET FORTH IN SECTION (a).<\/strong><\/p>\r\n\r\n

(h) IN NO EVENT SHALL TAJIMA TOOL BE LIABLE TO YOU OR ANY THIRD\r\nPARTY FOR ANY LOSS OF USE, REVENUE OR PROFITOR FOR ANY\r\nCONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR\r\nPUNITIVE DAMAGES WHETHER ARISING OUT OF BREACH OF CONTRACT,\r\nTORT (INCLUDING NEGLIGENCE) OR OTHERWISE, REGARDLESS OF WHETHER\r\nSUCH DAMAGES WERE FORESEEABLE AND WHETHER OR NOT TAJIMA TOOL\r\nHAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.<\/strong><\/p>\r\n\r\n

(i) IN NO EVENT SHALL TAJIMA TOOL\u02bcS AGGREGATE LIABILITY ARISING OUT\r\nOF OR RELATED TO THIS LIMITED WARRANTY, WHETHER ARISING OUT OF\r\nOR RELATED TO BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR\r\nOTHERWISE, EXCEED THE TOTAL OF THE AMOUNTS PAID TO TAJIMA TOOL\r\nFOR THE PRODUCTS SOLD HEREUNDER.<\/strong><\/p>\r\n\r\n

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU\r\nMAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE. SOME\r\nSTATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED\r\nWARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.\r\nSOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF\r\nINCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR\r\nEXCLUSION MAY NOT APPLY TO YOU.<\/strong><\/p>\r\n\r\n
